SECTIONAL TITLE

Sectional Title is the division of a building or buildings into 2 or more sections which allows for separate ownership of each section in a development.

A "section" is defined by four walls, a floor and a ceiling. Any part of the building which is not included in a section constitutes "common property". These common areas and all the land outside the buildings are owned and managed by the Body Corporate which is made up of all the owners in the scheme.

Sectional Title units can only be created if the buildings on the property are built as per the approved building plan. Furthermore the proposed division must not contravene any town planning scheme or conditions under which the development was approved.

The use of the common areas can be allocated to an owner of a section for their exclusive use. These exclusive use areas may include parking, storage areas, yard areas, garden areas etc.

A draft sectional title plan is prepared by a Professional Land Surveyor and the plans must be approved by the Surveyor General. Once approved, a Conveyancer will lodge the sectional title plan in the Deeds Office. When the register is opened, transfer of the individual sections and exclusive use areas can take place.
